Storage Tank Laws
Owners and operators of aboveground and underground storage tanks must comply with Navajo Nation requirements for storage tank installation, maintenance, performance, monitoring, retrofitting, upgrading, reporting, and cleanup. Certain provisions of the Navajo Nation Storage Tank Act and its implementing regulations also apply to tank installers and persons who deliver regulated substances (including petroleum) to tanks. Examples of these requirements include:
- Operator training and certification
- Installer Certification
- Storage tank fees and tariff
- Tank design
- Proof of ability to pay for corrective action, injury or damages
- Leak detection system release reporting
- Other notification, reporting, and record keeping
- Corrective action in response to a release
- Entry and exit environmental assessments
- Proper closure and tank removal
- Appropriate secondary containment
